Just wanting to hear everyone's opinion on this.

I often see advertisements with the following or similar type disclaimer:

"Any money exchanged is for legal adult personal companionship an is simply to compensate me for our time. I do reserve the right to decline appts. By contacting me by phone, you agree to all these terms an hereby agree that you are not part of any law enforcement agency using this advertisement for entrapment. This is a contract you agree to by contacting me."

Does this really hold water in court?

What are your thoughts on this?

IMHO...it's kinda silly. Lots of ladies print that statement on their ads and websites. Think about it...that's just printing the fact that you KNEW there was a law against illegal activity if you end up in court.

Same thing with using words like roses, kisses, or exchanging services for fixing a car, computer or pretty much accepting anything...as long as something has value, then it's the same thing as $'s. Just my opinion though.

It does not hold up anymore...kinda stupid if you ask me. Whatever it takes to keep the wrong people off of my butt and the right ones on it LOL!

Ask yourself this, will a jury of 12 average people believe that or not? Unless you are trying to ward of an initial indictment, (which is a long-shot at best) I don't think it will work.

Interesting. So I agree the disclaimer is bullshit but I have to ask if something so minor would ever be worthy of an actual indictment let alone trial. Just trying to get educated.

Texas has no entrapment law. So stating that is relatively redundant. In Texas a police officer does not have to tell you he is LE if you ask. So no this "statement" is not going to help you stay out of trouble if ever busted. As far as it going to trial... It is a class b misdeanor, not very serious, but you could take a traffic violation to trial if you wanted to but this statement wouldn't hold up in court.
