Too many people declare "victory" when the Court issues an opinion without actually reading the opinion AND taking into consideration the procedural status of the case and/or the effects down the road when a set of facts arrive that are distinguished from those in the current litigation.

The Courts are not supposed to decide cases based on politics. That's what the CommunistSocialistLiberalDumbo Crats are attempting to create .... political preference .... like they do when they give illegal aliens money!

You "think" incorrectly. After you have actually read a sufficient number of appellate decisions, including those from the SCOTUS, you will realize that "fear" is not a concern, but qualified judges rule based on an application of THE FACTS to the applicable law.

Look at California's Federal Appellate Court ... packed with Liberal Idiots and gets overturned on a regular basis throughout its history....even when the SCOTUS was weighted "left"!

That's the whole purpose of selecting "strict constructionists" for the appellate review of all the appellate courts in this country and the territories. When a person is to get the death penalty, their "political" beliefs and/or associations should remain NOT RELEVANT.

I can't keep count of the number of times John Roberts has been accused of making decisions concerned about his legacy instead of ruling on the law.


Every single person who pays any attention to this subject should understand what is happening here. The Left believes in a "living Constitution" and matters should be decided on what they "feel" is the right answer for "this time". Conservative Judges believe in "textualism". Read the words just as written regardless of the "times" and if the law has not caught up to the times, that is the job of the Legislature, not the SC. Liberals believe in adding/ making up words that can not be found in the text. Conservatives ( generally ) do not.


It is as plain as the nose on one's face that the Left wants power back in the court and they want it right now, not through the normal process.


What ever they are going to do, they better do it fast because in 1 1/2 years, they could very well lose that 50th seat and their dream of ending the filibuster with 50 votes plus the VP is up in smoke.


What I wouldn't give to see a Democrat Senator in a Republican Governor state, leave by death or other means and the Republican Governor replace him or her with a Republican, instantly taking away their majority. I'd be laughing for days.

My objection is the use of the word "fear" .... which is a personal emotion as opposed to a legal evaluation. Almost since its beginning the SCOTUS has repeatedly stated in opinions that it refrains from deciding "political" cases and/or cases that are legislative in nature. That is not "fear" that is historical precedent and good policy.

The current effort is PURELY POLITICAL when PACKING THE COURT with more judges to offset the current PERCEIVED makeup of the Court with respect to alleged "political bias" based upon Trump's selection and the Senate's approval during Trump's Presidency.

The SCOTUS stands as a third branch of our government to assure the other two branches remain consistent with our Constitution when they act and pass laws. Expanding the Court to simply get approval of acts and laws is the destruction of the purpose of the independent third branch .... independent, because the appointments are lifetime in nature to assure their independence.
