So I'm going to ask, did he get jail time, like Richard Marcinko did, for his actions while in charge of Red Cell? Giving up information that is top secret is punishable under military law.

Well then you sort of missed the point. The Rat is an opportunist his survival is contingent upon his ability to obtain food that is readily available, so he steals.
