DWI

My dumbass brother got pulled over and arrested for DWI last week in San Antonio after a Spurs game. Since I'm not originally from the area, does anyone recommend a good attorney to try and fight his case? I don't know all the details, but I'd appreciate any suggestions.

I would give Carlo Key a look. He was a former judge and that carries some cache.

George Scharmen has a fantastic reputation, but my personal experience with him was not great. He did not adequately prepare beforehand and just flew by the seat of his pants at the trial. Needless to say, he did not achieve the desired outcome.

Interesting, I would have surely said George Scharmen... He took awesome care of someone close to me who was so busted... Made it disappear like a puff of smoke.... But that was 8 yrs ago.... Good luck!

Did he refuse all test? This is a huge factor. Need to know that before even touching a case

8 years ago would have been before the No Refusal thing in SA. I had a friend get busted around the same time, refused the tests, long story short ended up pleading down to something like "obstruction of traffic" or something vague like that. Hell of a lot better than DWI. He paid somewhere north of $17K in lawyer fees though, but he was military and that would have been strike 2.

He didn't. From what he told me they took blood from him

From what I understand, the blood test isn't totally admissible at this time. There is a dispute about the company that calibrates the equipment and whether it is done properly. It can be brought up in a jury trial, but the actual BAC level cannot be revealed, just alcohol present, yes or no.

I still say Scharman, as he is on the committee fighting the blood test, and employs his own calibration and testing company.

I have no sympathy for those that drive under the influence - no matter what substance was used. It is just a very selfish thing to do and can cause real harm to real people.
