Public Law 99-145 authorized the award for wounds received as a result of friendly fire. Public Law 104-106 expanded the eligibility date, authorizing award of the Purple Heart to a former prisoner of war who was wounded before April 25, 1962. The National Defense Authorization Act for Fiscal Year 1998 (Public Law 105-85) changed the criteria to delete authorization for award of the Purple Heart to any civilian national of the United States, while serving under competent authority in any capacity with the Armed Forces. This change was effective May 18, 1998.[5]

Congress sets the criteria and authorizes it in a law, President signs the law, DoD simply decides if criteria are met. Currently has to be a military member and in a war zone.

Better go and check the news stories. A Purple Heart is for being wounded or dying in the face of the enemy (the simplest definition). The White House classified the shooting at Fort Hood as "workplace violence" and not an enemy action. The dead and wounded did not qualify anymore than being killed by a drunk driver. This is not my opinion but the opinion put forth by the White House. They also said that giving out awards might negatively influence a jury at the trial. Yep, they said that. So now, with the trail over, maybe they will quietly give out the proper awards but don't bet on it.

Update: The House and the Senate have both added langauge to the Defense Authorization Bill but as of this date I am unable to find any reference to the awarding of Purple Hearts to the soldiers of the Fort Hood shooting.

If you're a tried and true Obama supporter than you may want to argue that it was the Army doing this but the Army works for who?
