They're trying to claim EP, and it isn't working.

There are two kinds of executive privilege. To invoke the strong one, Obama has to admit that he knew all about Fast and Furious, that he was in it up to his neck. He can't do that, for obvious reasons.

The second kind, the weak one, is what they are trying to use. The problem with the weak one is that it evaporates the moment any kind of showing is made that there MIGHT be wrongdoing involved. In Fast and Furious, it is already known, beyond reasonable doubt, that there WAS wrongdoing involved.

Holder is what used to be known as screwed, blued, and tattooed. He is in both civil and criminal contempt of Congress. Despite the referral, the US Attorney has refused to file the criminal case. I read earlier today that there are still three civil cases pending against him for it, and Boehner could still find his balls and order the House Sergeant-at-Arms to arrest Holder and throw him in the DC jail. (It is a valid reply to a writ of habeas corpus that the subject is being held at the request of the Speaker of the House.) His only hope is that this somehow blows over, and right now that doesn't look likely.

I would love to see Holder thrown in jail where he belongs. Boehner will never do it. He's got no balls. Holder can't cooperate with Congress' demands for more information, without revealing criminal behavior on his part. Not cooperating with the demands is also criminal. If the system was working the way it's supposed to, Holder would be finished.

It's the ultimate irony to have a crook as the head of the Department of Justice. It's like having Tony Soprano for FBI director.
