I really dont give a fuck if you've handeled a million cases. The FACT remains you're giving bullshit ass advice. She can accept it if she wants to but at the end of the day she is responsible for her own safety and no amount of cases you've handeled will protect her from the reality of THIS stalker. You're the one living in fantasy land trying to convince her she'll be safe if she sends a letter and call the cops if he approaches...and not to worry about physically protecting herself...haha That's got to be the most retarded ass advice I've ever heard a lawyer give.

I also think you've never spoken with, let alone, hired, a lawyer, Huggy Bear.

A protective order is a type of restraining order. A protective order protects the applicant by prohibiting the suspect from doing various things, such as assaulting or approaching the applicant. In big cities, like Houston and Dallas, there are special courts that issue protective orders. A restraining order can bar all kinds of conduct, from selling dangerous products to using someone else's trademark.

I bet there's a condition in his bond that he not contact you. That's common in these types of cases. Call the court and ask. If there is, find out the ADA on the case and tell him/her. The court may revoke his bond an issue an arrest warrant (called a "capias") to have him arrested and brought to court.

Shyster Jon please ignore SC.

SC attempts to derail every single thread he can and wears his ass for a hat.

The rest of us are very much interested in hearing what you have to say and would like to keep this thread on topic. I have read several of your other posts, Shyster Jon, in the legal section and the information you have is very appreciated.

;-) hmmm... The last lawyer I hired represented a case for me involving the SEC. ;-) 2 close friends are laywers. Have a former NFL player turned lawyer that married into my family. Plus I know Quanell X..and I listen to Rachel Maddow...so ;-) my advice to you is stop giving advice that will get this poor girl hurt.

I applaud you for your effort but it's historically never a good idea to force a square peg into a round hole or however they say that shit.

His case is already over and he was found guilty and charged over a year ago. But he was able to negotiate a plea and served no time (that's our justice system for you). So he is out free.

You would think he learned his lesson but he still contacts me, despite me telling him to stop.

This is why I was curious about the cease and desist, to be able to bring further action against him.

And of course for any other ladies that are reading this, who might be curious what power the cease and desist holds.

Shyster Jon is an extremely experienced attorney who is well versed in both the law and the hobby. You are not going to find much better advice than that, and most certainly not from the random joe blow's that frequent this board.

Is he on probation?

These are the steps I usually take against a stalker:

1. I call him and give him a "Come to Jesus" talk, calmly, but firmly. After that, chances are he'll stop the conduct. I think of all the calls like this I've made -- certainly thousands -- only one guy persisted, an Eccie mod. Haha. My second call to him wasn't calm or nice. He stopped the stalking, but tried to take some action against me with the Bar.

2. I've sent cease and desist letters, but not in the context of the hobby and stalking. Like I said, a call ended the problem so a letter wasn't necessary. Most C&D letters I've sent have been regarding a sugar daddy-sugar baby relationship gone bad. But the same basic principles would apply to a provider-hobbyist situation. The letter should allege a violation of the law and a remedy if the stalker doesn't comply with the demand. The remedy would probably be...

3. A protective order. The C&D letter would be good proof to convince a judge to issue one.

I'm an attorney who specializes in criminal law. Many of my cases are specific to the hobby. I've dealt with literally thousands of cases of stalking, blackmail, and harassment over nearly 40 years.

My advice to the OP is the following:

1. Don't respond to any future communications from the stalker. Stalkers feed on the response they get from their target. Don't feed the stalker's obsession. I wouldn't suggest you block communications from him because he may give you warning of what he'll do. Just don't REACT to his communications.

2. If the stalker is making threats, or otherwise engaging in behavior that would violate the Texas stalking or harassment statute, notify your local police.

Texas Stalking Law
Texas Harassment Law

3. If the behavior continues, consider conferring with an attorney. When I call a stalker, 99.99% of the time the behavior stops. A cease and desist letter or seeking a protective order are also options.

4. Ignore the advice of amateur Eccie lawyers about the use of force. They're idiots who don't know the law.

If you have any questions, my contact procedure is in my sig line.
Interesting points Shyster. Are you trying to earn 3 clients, or are you offering your services, i.e., that call that works 99.99% of the time, pro bono? Obviously a protective order is a different animal and would tie up many work hours.

This guy sounds like a clown and probably isn't dangerous, but who really knows? I think the gals should carry bear spray as non-lethal self defense in case this bloke accosts them out of the blue. Would you disagree with that advice?

I have a JD but do not practice. Obviously, you have a lot of hands-on experience in this field. That's great! Clearly, you have a lot to contribute to the board imo.
