So I got home today to a bright yellow sign in my front lawn that says wny tax auction.. so I been buying this house on a land contract and owner was supposed to pay taxes till the house was paid and mine... the taxes were included in Morgage.. so anyhow the house is up for auction on June 22, I have a 13 yr old son and have put my heart sole and every bit of money into this place.. like seriously I'm devestated i feel helpless.. so I called treasurer and 13,000 is owed bc hasn't been payed since 2012.. so I can pay it and keep my place and have the owner sighn it over for 13g or test my luck and go to tax auction and get it for maybe a thousand or loose it all bc it goes for 40,000.. im sure it won't but js I have no clue.. idk what to do.. I live in a small town little junky farm house that I have put my life into and I'm just cant loose it all..like seriously I'm a mom I have made it so good and done everything for my son done everything to make good for him and this is where I'm at.. I can't stop crying...
Anyone who knows anything about auctions and knows how this works please get a hold of me..I'm thinking the best bet would be to go to auction and I will get it cheaper then the 13000 owed but I don't even know how these things work.. Idk what to do..
I'm thinking if I go on a last min tour out of state I could prolly make like 14,000 if I really try and put everything into it.. I don't even know, I always did this just to pay bills and so my son had everything he wanted and needed.. I don't have money saved, I never really made a career out of this or anything else.. like seriously im lost, idk what to do.. ik there are some really intelligent guys here so please if u have any knowledge on auctions and situations like this please reach out to me..

Oh no! Sorry this is happening, nobody deserves that. Is there anyway the irs will set up a payment plan with you? I'd think if you make a good down payment they would. I know you always talk about your house and all the work you've put into it's shady of the owner to have done this to you.

+1 IRS does nothing with property tax. It would most likely be the county.

You still have rights
You still get to live there and do anything you would do with a property you own. You can choose to sell or rent it. If you choose to sell, the taxes will be paid out of the money you get for the property. You have the right to redeem (pay the taxes) the property right up to the day the judge orders the foreclosure final.
Foreclosure is a long process, typically at least 4-6 months but it can take years. Everyone who has an interest in the property, owners, heirs (in the case of a deceased owner), banks, etc., will be notified by certified mail and the sheriff will post a notice on your door. Avoiding the certified mail may not stop the foreclosure, but it will keep you in the dark about what is happening.
A person cannot lose a home without a foreclosure. You should get a notice mailed to you 60 days before a foreclosure is filed. Paying now will save you the cost of the foreclosure. Once a foreclosure starts the legal fees will add up quickly.

Is there a number to call on this yellow sign? Something about your description of it seems suspect to me.
Call around and lawyer up. Would be my advice.

If it were I, I wouldn't chance the auction. There are company's out there who are opportunistic and will jump on buying forclosures or real estate in tax auctionse. Assuming the house is worth more than the $ 13,000 and the owner is willing to sign it over to you, I would jump at purchasing it for that price and not risk the chance that someone else will try to buy it.

Even if you were to have an offer accepted at the auction for a figure less than the amount of the accrued taxes the property would not be conveyed to you until they are brought current. Not sure if it would do much good at this point but if the land contract was filed with the county and jointly singed,you could initiate legal action against the property owner for breach of cntract and he would be legally forced to bring them current.

not my area of expertise but I would think 13 k is cheap for a house. buy it while you can. I am sure you don't want to lose all the time and energy you put into the house . if you do the state tour, I would happy to help in that way

I would ask a lawyer in your area to help you.
You might also contact the owner, he still has the right to show up and pay the taxes. You might want to offer him $20k, it would let him pay of the $13k and pocket $7k instead of nothing. Like Likedyclit said you may have some recorse with the land contract, you probably assumed that a portion of the payment was going towards the payment.
Either way talk to a real estate lawyer. A couple hours of lawyer time will be we'll worth it. Why do you think we go to PROFESSIONALS ?

I'm not a lawyer hon, however I hold several land contracts both here in wny as well as Florida thus my familiarty with the logistics . Would be happy to look your's over before you involve an attorney, besides my fee is only a blow job,lol
