Historically, the first amendment did not cover fightin' words. If you were to tell someone that their wife was a whore or you called someone a pig with the intent to anger a reasonable person, you were on your own. No constitutional protection. That was first adjusted in the 1820s.

Yeah, this is what many on both sides don't get. I absolutely condemn the violence and oh by the way if a BLM supporter is looting / breaking into a shop and the owner is in there with a gun they have every right to shoot the same as the Capitol officer.

You watched the video of a barricaded door, with a woman going through the window, and are telling me that there was a crowd going in? You'd "shoot the ceiling"? What the fuck is that going to do? You never shoot to warn - that's asinine. You shoot to stop threats. Period. That's what happened.

Simple really cant use deadly force on non threatening unarmed person , some fed areas yes but nobody else was killed so?

Correct. Legally there are no such things as "warning shots", because warning shots are a dangerous idea. There are proper shots, and negligent discharges.

1.) I can in Texas if it's nighttime, dark out, and I have a trespasser. I don't have to prove that the assailant was armed before I decide to protect myself.
2.) Its easy to kill someone with your bare hands. Even one good punch.
3.) Its even easier to disarm someone and take their weapon from them and use it against them.
So if you're going to physically threaten me, and you're within 20 yards of me, I'm shooting your ass.

That statement is not true. You can ask Fred Yazdi. I remember this case well since I at one time lived in Avery Ranch. In Texas, at night, trespasser. Serving 20 years.
20-year prison term for man who shot Texas State student
The wife of Fred Yazdi, a 49-year-old homeowner, woke him, saying she thought there was a burglar outside their home. Yazdi grabbed his gun, went outside and fired three shots into Recio as the 23-year-old scaled a fence to flee.
As Richardson sentenced Yazdi on Wednesday to 20 years in prison, the judge explained how Yazdi went too far. He could have stayed inside his house. He could have fired just one warning shot. He could have waited for police, who were just a few blocks away.
“Getting drunk and crashing a car and stumbling into someone’s yard doesn’t warrant a death sentence,” Richardson said. “If Mr. Recio had stumbled into another front yard he would probably still be alive.”

That group crossed a line. They were not simply rioting and looting. They were attempting to overthrow the lawful actions of the US government (read carefully, I did NOT say overthrow the government). That is not a RIGHT granted to citizens and should not be tolerated as a precedent. Don't forget that the idiots were also dumb (yes, could well prove out dumb when it comes to their defense) enough to construct a gallows on the west side of the capital making them a legitimate threat to the safety of duly elected representatives in the capital, not to mention the Vice President of the United States.
