Yes, the video is the property of the shooter and he has copyright protection. This is why a DMCA should not work. This does give him the right to use the content. It comes down to usage rights released by the person on film. Since nothing was signed, the OP would likely win, but with no damages unless there was commercial benefit.
Someone owns the film from Superbowl 1, but couldn't do anything with it.
