Of course you are being detained, do you even need to ask. He just pulled you over. I could be wrong but as for now I don't believe that he has to tell you why exactly at that point you are being detained.

You know what I would do so to not waste tax payer money and make things harder on myself, and give a guy a hard time for just doing his job when I was the one who made a mistake. Be polite because he is just doing his job and admit I screwed up. I would also tell him if we have a discussion that I like most people get a little nervous when a cop is behind me because I feel like my driving is being judged and I just wanted to get out of his way and made a mistake. You would probably both laugh a little about it because I am sure he already knows people are nervous and he wasn't always a cop. Then when he gave me a warning I would thank him and tell him have a nice day.

He doesn't have to tell you UNTIL you ask, then he is required to tell you. If he says no then you can leave.

The cop was an overzealous turd. Did she have an attitude? Yes, but cops are taught not to escalate a situation.

If he says I'm not being detained, I can leave. There is not a damn thing he can do about it. If he says I am being detained, he has to tell me why. Right then, right there. You're an idiot if you give the police more power than they rightfully have.

I don't know where you get your "law," but your source is wrong.

When the trooper signaled the traffic violator (Bland) to pull over ... she was "detained"! (Actually "under arrest") She was not free to leave until she signed a ticket, which is a promise to appear .... There is no law that says he has to tell her shit, other than what is on the ticket, only because she is promising to appear in court as a condition for her release. And since she is out of state he can take her to jail where she will have to bond out to be released (writing a person out of state with a promise to appear is a waste of time and energy) ... (He could have taken her to jail for the lane change violation, even if she had been a Texas licensed driver.)

in fact .... in reality the trooper more than likely would NOT TELL HER why she was being "detained" beyond informing her he pulled her over for the lane change violation.

I don't have enough information to decide if he was overzealous and neither do you. One thing I do know is he got someone off the road who was not in condition to drive. She was higher then shit. Did he sense she wasn't in condition to drive? Neither you or I know. Did she blow smoke in his face on purpose which prompted him to tell her to put out the cig and then when she didn't do that then prompted here to take care of the ticket business out side of the car? Neither you or I know.

I always laugh when I see a video of a clown like you telling the cops what they can and cannot do when they are roughing you up and putting handcuffs on..

SCOUS has ruled a officer cannot prolong the traffic stop beyond intended reason, once that has concluded then it is over. The officer after writing the ticket has no authority to ask her to put out her cigarette. Anything after that was a ego trip. Rodriguez vs the US.......

Wrong. he can ask her to put out her cigarette for sure.He didn't tell her she had to put it out he asked her nicely and even said please if I remember correctly.

Now do you know if she was blowing smoke in his face? I know I don't. And he does have the right to tell her to get out of the car. Do you know if he suspected she was high as hell or not? I know I don't.
