Overkill
Are you really so blind to the facts and so dense about how justice is supposed to operate in the USA?
The "crime" was a trivial one of merely selling loose cigarettes by a poor guy trying to eke out a living, but the choke hold by the idiot policeman was something the Gestapo would pull on a Jew in Nazi Germany.
That "officer" as you called him was only a moronic thug hiding behind his badge to oppress the people he's supposed to protect and he should be held accountable in a court trial.
. . .This is not how a civilized society should treat its citizens and your attempt to blame the victim only adds insult to the injury and highlights your cavernous ignorance in the process.

I doubt Mr. Garner died from the application of the choke hold in and of itself but rather the fact he was grossly overweight and the excessive exertion coupled with health problems may have been the true culprit of his demise. Furthermore when Garner said he couldn't breath he actually could, cause you can't speak when you are choking. He most likely was beginning to panic. The Officer involved wasn't trying to kill Garner nor did he do anything that would ordinarily cause death.

Now that Fast Gun has opened his mouth but has failed to see the forest because of the trees, I will chime in.
A- Garner has been arrested many times for having illegal cigarettes in his possession. Once was arrested with them while driving without a licence.
According to the Staten Island Press:
"Garner, 43, gave cops a phony name and put himself in more hot water when officers allegedly found untaxed cigarettes and a small amount of marijuana in the 1998 Lincoln Navigator he was driving, the complaint said.
He was charged with aggravated unlicensed vehicle operation, false personation, possession or sale of untaxed cigarettes and marijuana possession, according to information from District Attorney Daniel Donovan’s office.
Seven months later, while out on $1,000 bail, Garner was busted on March 28 for allegedly selling unstamped cigarettes on the street outside of 200 Bay St., Tompkinsville. He had 24 packs of untaxed smokes in his possession, police said."
Garner was, according to Rush Limbaugh. a disabled landscaper who having 6 children was certainly drawing public assistance. These charges were certainly causing problems with that due to the income he was not reporting. it is a crime to lie about earnings when receiving benefits.
Let's do some math. 24 packs of cigs is 480 loosies"" and he was getting a buck a piece so $480.00 that is what he had on him in one day at the site he was selling them. I am sure he had some costs but smokes are less than $6.00 in VA. so his costs were $144.00 se he net profited $336.00 a day or $1680 a week with no other costs of doing business, no licenses, no rent, and competing with local merchants who had overhead.
The police were acting upon their complaints when they approached him. We have no way of knowing how long they had been there before the "freind" who is facing felony charges for gun violations started the video.
There are pictures showing the officer had one arm around Garner's arm and another around his neck which is a take down maneuverer,
Garner then hauled the officers in front of the store next door and spun the officers around putting officer Daniel Pantaleo into the glass where he lost his initial grip and held on to him by the neck finally forcing him down once down he quickly repositioned himself to holding the mans face down and that is when Garman said he couldn't breath.
In my opinion this is where the atrocity takes place, No one checked to see if he was breathing at least that I could see but one officer said he was and when the paramedics got there they did not check his breathing just his pulse, loaded him up. We have no further information as to what was done to preserve this persons life. No comment in what could be a blotched Medical exam and the ME's office has not a stellar reputation for due diligence. But the NYFD has made statements but no facts have come forward. Facts that surely were heard by a Grand Jury.
These are facts, I make no assumptions but I think Garner was really a THUG in a 43 year olds body making a dam good income, while bilking the system.
P.S. cigarettes are taxed by the city at $1.50 the rest is NY state taxes. taxes on cigarettes are higher in Chicago than NYC.
If Garner, would have been arrested in a peaceful manner, which means he cooperated he would have lived. After they shut down his income and settled his legal matters with the city and possibly the state and the IRS, (causing him to loose his "entitlements".) what new venture would he become involved in?

I just love the way his wife got on TV and ranted about "who was going to support them now"?
Give me a Fukin break. Garner was supporting them with illegal activity and what ever he could fleece from the welfare department.
On CNN today, they had a big round table discussion on why the police had to be so aggresive in the arrest.
Ok, let's look at that. Suppose they just said, "Mr a garner, would you please get in the patrol car. He says "no" so rather than force him, they just write a citation. It has a court date. Garner doesn't show for court, so they issue a warrant. Then a warrant officer goes to pick him up, he says he ain't going. So they send some Marshals out, he tells them to get lost, so they finally decide he has to go in. So a big struggle occurs, he has to be taken down and arrested by what ever means neccessary, because remember, he has been told by Al Sharpton and the Mayor that he does't have to submit to police authority.
So, the ugly scene that was avoided on the street was simply postponed until he finally had to be taken down, handcuffed, and hauled to jail.

The fine for a pack of untaxed or falsely stamped cigarettes in NYC is $60, $600 a carton, so the fine for the 24 packs is $1440 which is less than a weeks work for Garner. Chump change? By someones estimate if he worked a full work week he was probably clearing over $100K plus entitlements. More on this another time.
So why is he out on bond since August 2013 for driving without a license, Possession of MJ, possession of bootlegged cigarettes, and telling the police he was someone else?
During that time and when he died, he was arrested 3 times for selling untaxed cigarettes.
He had 6 outstanding court cases going on at one time and $5k tied up in bond money. You don't think his wife, (or GF? see below, it gets better) was on his ass, or was this accepted behavior from him? She is planning on suing for $75M and has advised NYC legally.
Why was this case allowed to be dragged(can't refer to drug's here, LOL) out for over a year at the time of his death? His next court date was to be for October and he was being represented by a court ordered attorney. He should have been in jail for giving the police someone else's name when caught with the goods (note the reference to Dorian Johnson in Ferguson) then he would have been on probation for driving while suspended, the false impersonation, possibly the MJ possession. and possession of illegible cigarettes. He than would have been risking his freedom for selling loosies in front of another mans business who cells legal cigarettes, pays taxes, and has proper licenses.
He would have been in jail and this would have never happened.
Now he is dead, police are under fire, and his wife who condoned his illegal activities, is now opting to sue for $75M? for wrongful death of a man who appeared to be close to being there on his own? (not really he must have been better than they thought. Read on)
Explain this?
“He was a great dad — he’s just a warm guy,” Jewel Miller, the mother of his youngest child, described Garner to the Staten Island Advance. Though the two were separated at the time of his death, she has nothing but warm memories of Garner and how he cared for their 3-month-old infant, saying that he was “proud of his daughter.”
NY Daily News; “My trust in the justice system ... I don't have any,” said Jewel Miller, 39, Eric Garner's girlfriend. She held his 5-month-old daughter, Legacy Garner"
THAT'S RIGHT, MISTRESS WITH CHILD
You cannot make this up!!!!!
Hopefully more on Mrs. Garner's knowledge of her husbands activities, both personal and business, and NY State tax inquiries, cigarette and income, along with a possible welfare fraud investigation. Oh wait it gets better as the IRS will chime in and then there is the mother of the youngest child who may throw a wrench in everything. Last but possibly the most dangerous there is Eric Holder and the Feds. I can't wait for the mini series!
YOU CAN'T MAKE THIS SHIT UP BUT YOU MAY NEED A PROGRAM BEFORE THIS IS OVER. Hint He's not the real grandfather. Film at 11

Iam sorry you feel that way, but I'll chalk it up to the fact you obviously have no experience or knowledge in these areas.

Payday in jail. I would like to be a mouse in the Jersey St. projects when the welfare people come by for a visit. I bet she will have her atty ( who was recently arrested for rape) on site. Think of it an atty in the projects.

Damages?
Loss of consortium .... he's got a mistress with a child?
Loss of income in the future .... he's on welfare?
City of New York .... offset .... reduced food costs for the family.
City of New York .....offset .... recovery of unpaid taxes, penalties, and interest.
U.S.A. ...................recovery of unpaid taxes, penalties, and interest.
Bring it on!
Hopefully the attorney filing the suit can pay sanctions for a spurious lawsuit.

He is out on bail in a NY rape case.. involving, get this, one of Rev Sharptons people.. I told you you can't make this shit up!!
STATEN ISLAND, N.Y.- The high-powered attorney representing Eric Garner's family has been accused of raping a woman who has ties to Rev. Al Sharpton, according to a report in the Daily News.
Sanford Rubenstein, 70, allegedly assaulted the 42-year-old executive at his Manhattan home following a birthday bash for Rev. Sharpton Wednesday, the article said.
The accusation is being investigated as a third-degree rape, a source told the Daily News.
Rubenstein is known for his high-profile cases and has represented a slew of other police brutality victims, including the family of Sean Bell, the paper said.
A spokeswoman for Rev. Sharpton's National Action Network confirmed the woman is a top official at the network.
Garner (who now goes by Snipes-Garmer sometimes just Snipes) announces a week later
Part of that struggle means making difficult, but important, decisions on how to proceed with its $75 million suit against the city and NYPD following the rape accusations leveled against their former attorney, Sanford Rubenstein, last week.
Garner's wife, Esaw Snipes, and mother, Gwen Carr, still visibly emotional over their loss, expressed the trying decision to move in a different direction and hire civil rights attorney Jonathan Moore at a rally Saturday at National Action Network headquarters in Harlem.
Now get this Eric's son Eric JR goes by Eric Snipes something smells bad here..
