I don't see where it says you "can not" pay over 9.5%
9.5% of income is the level that the government has determined is affordable. It looks like employer plans have some restrictions on them that requires the employer to either make sure none of there employees are paying more than 9.5% of their income or pay basically a penalty.

There's nothing about individual plans not costing more than 9.5% of income. If there was why would these insurance companies be offering Gold plans to subsidized enrollees.
Looks like shanm needs to do a little more "research" and get back to us.

Did you not read point number 7? where exactly does it mention employer only? the only requirement seems to be that IF you qualify for government assistance. Either you are blind or extremely stupid.

If you're making less than 250% like your friend is, and qualify for a cost subsidy, you only get a subsidy if you apply for a silver plan. Maybe that's your "friend's" problem? living beyond her means.

That was my understanding when I originally read it and saw the regs.

Here's an explanation of the "free money" ..... "subsidies"

"Example: Ernest, a 45-year-old single self-employed writer who lives in San Francisco, obtained health coverage through the California health insurance exchange (covered.ca). He estimated that his 2014 income would be $30,000. Based on his age and income, he qualified for a premium assistance of $216 per month, or $2,592. Based on this income, he was actually entitled to premium assistance of only $109 per month, or $1,308. He received $1,284 more in assistance than he should have. There is a chart on that website (a law firm) explaining income/subsidy.

A "problem" is the unions are exempted from the requirements, and there are employers locally (Texas .. "right to work") who are cancelling insurance plans and "unions" for that trade are picking up the employees in their insurance.

Additionally employers are cutting hours below the 32 hour cap, and terminating employees and bringing them back as "contract labor," which is exempted from the requirements by definition.

Some "associations" are establishing "group plans," which will help with the pre-existing conditions and some lower rates, because of the increased number of policy holders.

All of the above is outside of the ACA.

The subsidy is based on the cost of the second lowest cost silver plan. In this case that is a piece of crap HMO that still costs $215/month after a $138 subsidy. You ever had an HMO? Might as well not have anything. and save the money if you can. In order to get to a decent PPO it's gonna cost over $320/month. Obamacare won't subsidize that so you can pay over 9.5% and not get credits.

In either case, I gave you the basic numbers of what it costs to live and I mean just get by on $2400/month gross. If living in a efficiency apartment, driving a reasonably dependable beater and getting by on basic necessities is living beyond her means then I'd say there are a whole lot of American living beyond their means and they just got penalized a few hundred dollars more for doing so.

What this says is the AMOUNT of subsidy is based on your second lowest cost silver health plan. There's people living on Bronze health plans man, Silver one's are actually pretty good. Are you advocating that she should be on a Gold or Platinum plan now? Sorry but someone making 24K a year can't do that. I thought this entire thing was about socialism?

If you go back and read what I said before you jumped on my back, you would know that I made it clear that I was never for Obamacare, and still am against it. What I don't stand for is people making absolute bullshit to get some brownie points from their butt-buddies on here. After actually looking at the data, I know for fact that Obama care isn't as bad as you guys make it out to be and is certainly a whole lot better than what we had a couple of years ago. Don't ask me to defend Obamacare because I don't really give a shit. However, I'll dick-slap any bitch that decides to make up bullshit once again.
