Here's the reality. When you board a plane, you give up almost all of your constitutional rights in the interest of airline safety. And yes, Dr Dao was legally supposed to be notified in writing before being physically ejected. Is that a realistic expectation in real time? Probably not.
Anyone ever travel on the last flight of the day, to make an important meeting first thing in the morning? I've passed countless voucher offers in situations like this, because I had to be somewhere the next morning. I suspect he had patients as stated, and maybe missing that one day of work was hugely problematic considering his parole terms?
Most people don't know airline regulations, and my guess would be Dr. Dao falls into that category. As such, he felt that he had a right to remain on board since he had paid for a ticket.
United, and the Chicago Airport Security staff are equally at fault. United could have easily increased their offer and someone would have accepted. Even an absurd offer of $5,000 would be far less than the millions of dollars that will now be involved, in a settlement and loss of business.(The law caps mandated compensation at $1,350)
More important though, where was the judgement of multiple security members in exerting that force on an almost 70 year old man? These folks are supposed to be professionals, trained to manage situations like this. No one was in danger as a resut of the Dr. Dao's refusal to deplane, yet they used extreme force. In my mind, their poor judgement is more egregious than United's policy.
With over 2 million miles under my belt, I've witnessed two ejections from flights for intoxication. While they were not violent, they were still very unsettling. I can only imagine the horror of the other passengers in this debacle.
In the end, legally Dr. Dao was wrong. However that does not justify the excessive force used. History shows us that sometimes, poorly written laws and/or policies need to be challenged in order to be changed. Maybe...hopefully... this is one of those cases?

How can those people (security, airport police, air marshalls or whoever) assault a person who has committed no crime (sorry..UAs policy is not a law) and not themselves be arrested and charged with a crime(s)?

Perhaps. However, the PR team for the airline should have advised everyone of people trying to do that and handle issues much much more delicately.

It's unfortunate what happened to the doctor but if you think about it, what's authority to do when someone refuses to follow directions? Do they back down and let the DR. have his way? I'm all for equal rights but I'm no fool either
