It was not a different set of rules. In Comey's statement he was talking about 18 USC 1924. Comey "very few of the classified emails bore markings indicating they were classified" So what is in the header "DOES MAKE A DIFFERENCE"

18 USC 1924 does not call for "jail time" if you should have known you received and email that was classified but you didn't know and didn't protect it. At best you lose your security clearance to view classified information or pay a fine. HRC was not SOS anymore when Comey gave his report to Congress. If HRC was a republican you would not be calling for jail time.

HRC had a minor violation of 18 USC 1924. She received some emails that had a "C" for in front of the sentence. Which means that sentence was classified. The email itself was not marked classified in the header by the sender. This is what Comey told Congress. "For not knowing that you had classified information and failing to protect it" you lose your access to classified information and/or pay a fine. HRC had already left the state department and did not have access to classified information at the time Comey gave his report. Thus, no charge. Republican's wanted her to get jail time for a minor violation of 18 USC 1924.

Out of 150,000 plus emails, none were marked classified in the header (and it does make a difference). There a couple of emails that had a single sentence or two out of a dozen paragraphs marked "C" for classified sentence. 18 USC 1924 does not call for jail time if you mishandled a couple emails that were not marked classified. According to the State Department, there were 2,093 email chains on the server that were retroactively marked as classified by the State Department as "Confidential," 65 as "Secret," and 22 as "Top Secret." Some of the documents were related to Keyhole which is NSA speak for satellite photography.

You keep trying to downplay how many of the documents were classified and intent.

Intent doesn't matter in this case. It's open and shut, she she committed a crime (with the obvious intent) and then tried to cover it up (bleachbit)

Your're right. Biden needs to do two things to get to 270 electoral college votes. Win the same states HRC won and flip Mich, Penn and Wisconsin. Right now Biden is +7 in Mich, + 7 in Penn and +6.3 in Wisc, well beyond the margin for error. Trump/Pence are going home Jan 2021.

The word retroactively is key here. How can one knowingly mishandle documents that were NOT marked classified at THE TIME THEY WERE SENT? Again, you can't be charged with violation of 18 USC 1924 if you did not knowingly mishandle classified information. You (from your own post) admit that the information was retroactively marked classified. It's not that there is one set of rules for HRC and another for everyone else. You have your own interpretation of how 18 USC 1924 reads. HRC did not remove any classified information from the government server. The information was not marked classified in the header or as Comey put in very few markings with a "C" indicating classified information.

In Clinton's case at best you would lose your access to view classified information or pay a fine. You may not like it but 18 USC 1924 does not call for jail time for "not knowing" the document someone sent you contained classified information.
