Did you even read the article? Or the original ESPN article that your article linked to? Or did you just read the headline?
Let me summarize. It's an ordinance that's not typically enforced. However, in this case, given the size and location relative to the 2011 US Open, the kids were asked to shut it down. They ignored the authorities twice (i suppose you advocate kids ignoring authority, but that's neither here nor there) and were fined. Ultimately, they agreed to move it to a more agreeable location, and the fine was rescinded. As was the requirement that they get a permit.
So try harder next time.
