As for his employer it will depend on whether he is union or not.
The unions got an administrative exemption on the standards, and as a consequence there are employers in Texas, for instance, a "right to work" state, who have shifted health care from their responsibility to a union associated with that trade, who is delighted to get the membership and additional health care premiums in their plan administration. That shift began years ago.
I'll be intentionally vague. Some of those unions have attempted to wedge into a "negotiating" status, but they have no leverage to make any good deals for the employees, since the employers can shit can them for refusing to work!
