It is not unconstitutional if you have been arrested for soliciting or suspicion of soliciting and it was on your person or in your car. The software has existed for years, federal agencies used it first for satellite phones for drug cartels, it is only natural that as it got cheaper they have found other uses for it as well. Like someone said, get a burn phone and dump it if need be because if they hack it remotely without probable cause then it will be much harder to use in a prosecution. Of course they probably do not care about prosecuting one fish, they are building a database of number, big brother is watching.
