The question should be, what gives the government the right to invade your right to privacy without a valid search warrant. Your phone being your personal property and as such an extension of your person should not be subject to a search without probable cause and a valid warrant. Just having a phone in your possession shoud not be cause even if you are arrested unless there is reasonable proof that you used your phone in the particular crime for which you were arrtested.

it's been argued forever, and certain rights have been defined by interpretation.
Fourth Amendment protects against illegal search and seizure. But...

The Constitution was not written to grant rights to people. The Constitution was written to establish a form and function of government and to establish limitation on the government, not to control the rights of the people. The so called Bill of Rights that is the first through the tenth amendments are not granting rights but limiting the control of government over the people. The people retain all rights including the right to privacy.
So if, as you believe, the Constitution grants rights, where is the one that grants the right to not be offended.

Actually, no. If you don't sync the phone with the cloud, they won't know who you contacts are. And that is a BIG deal. The iPhone has contacts that are only on the phone if you are smart enough to refrain from syncing it.
Text messages will be stored by the phone company, but that just means do NOT text with providers or text about any illegal activities. If you are engage in illegality, you should only be TALKING to the other party, not texting.
Also, destroying the phone will make it near impossible to figure out your account anyhow. They can't turn the phone on to even get your number. If they ask for your phone number, give them your real world cell number. Let them prove it was a different phone you broke.
Most important of all, the smashed phone should NOT be in your name. Get one of those cash-only burner phones. If it isn't in your name and your smashed it, they can't do shit.

So now you agree that much of the pertinent information is inside the phone and are changing the argument to the decoding information. Nice. Glad you see it the way I originally stated it. During the Zimmerman/Martin trial, the Martin phone was locked out. The phone company helped them unlock the phone and the IT guys for the police did the rest. The IT guy was fired because he was ordered to not turn over all the information retrieved on the phone.

What is and is not on the phone varies from phone, providers and how the phone is set up.
There's software to not just lock out the phone but to encrypt the data on the phone. The software and I'm not talking the std software from the cell phone, is very sophisticated.
I don't know about your phone exNYer but they can ID my phone by the numbers on the label behind the battery. The only way I'm going to be able to destroy it is by tossing it in a very hot fire - literally a burner. Even sticking it in the Microwave oven may not damage the sim card enough.
What I'm talking about is if the cops stop you for say soliciting (male POV). Make it difficult for them. I'd like to know how many regular johns who had their phone taken actually had a warrant issued by the police to break into the phone. For a female, same thing.
