Either one in Missouri will be a Class A Felony, so the punishment range is the same, and the judge can assess a life sentence ... especially for two deadly weapon assaults ... on police officers who are considered in Missouri (as most Model Penal Code states) as a "special class" of victim. In Texas police officers are lumped in with "public servants" as a "special class" of victims, and aggravated assault on a peace officer (public servant) is a 1st degree felony in Texas as well.

This whole thing is about a lawyer. He (or she) knows that shooting at, even if he missed, a cop gets more time than just shooting into a crowd. This is kind of like taking the fall for a robbery on the other side of town which gets you an alibi for a murder you did on this side of town.

Well, look at the bright side (glass 1/2 full). The lawyer (and I "assume" the thug aka "client") has confessed to having the pistol, holding the pistol, and shooting the pistol all at the same time when the two officer's were struck with rounds from the pistol. That is the State's "case-in-chief" and now the shooter takes the stand and explains .... err.... who he was actually trying to kill....
then the State rebuts with evidence that the genius could not have possibly been trying to shoot x, y, or z from the position at which he discharged the pistol in the direction of the officer's.
Now he's admitted pulling the trigger, but lied about his intent/motive. Then when he pleads for mercy on punishment, he'll be a lying sack of shit when he says he's sorry!

Based on the last "investigation" reports in the media ... my best answer is:
"I don't know."
Matching a slug or shell casing to his pistol doesn't put the pistol in his hand at shooting time with him pulling the trigger. The forensic/physical evidence will substantiate his "confession" (which is required ... some "independent" additional evidence to support it) ... and in the event he claims as is posted above that the confession was coerced, then the forensics becomes even more important.

If I understand that his attorney talked about his "defense" to the media and what he reportedly said (I didn't hear it), then if he is now claiming his "admission" was coerced, then he may be having a new lawyer on board soon. Lawyer's need to understand the 5th amendment also, and quit trying to get air time to build their practice.
