Well… don’t forget that Donald Trump and Matt Gaetz share a “Little Secret”
What that is exactly… I don’t know… BUT… it’s evident to me that all of this was planned and there is something deeper going on… and I’m sure it’s really really good.
But to stick with just the facts right now, let’s talk about what happens with his seat.
• Resignation
Gaetz has already resigned from his position in the Florida House delegation to pursue the Attorney General position. Once a member resigns, their seat becomes vacant.
• Vacancy
With his resignation effective immediately, the seat would be considered vacant until filled by a special election or until the next scheduled election cycle, which in this case seems to be in January.
• Special Election
Florida law allows for the Governor to call a special election to fill a vacant congressional seat.
However, the timing depends on the governor's decision. If the seat has been vacated for a significant period, a special election might have already been scheduled or might be in the planning stages. But… that wasn’t the case.
• Reappointment
If Gaetz wishes to return to Congress, he would need to be elected again.
There's no automatic reappointment process; he would have to run in the special election if one is called, or wait for the next regular election cycle if no special election is called in time.
• Legal and Procedural Aspects
Once resigned, unless there's a legal mechanism allowing him to retract his resignation (which is generally not possible after formal acceptance), he would have to seek re-election through the standard electoral process.
There may be some legal loopholes I don’t know about, but I don’t believe Gov Ron DeSantis can just give his seat back to him.
