What Happens if Ruth Bader Ginsburg Remains Too Sick to Work?
https://www.politico.com/magazine/st...-health-224014
Discusses possible remedies for removing supreme court justices who are sick or have conflict of interest issues from the bench.
out of a number solutions offered.
the writers solution is.... do nothing.
what a lame answer.

I agree with the article in many respects.
While it is unnerving to have a seriously incompacitated person in such a important position, I see no alternative aside from amending the Constitution.
A Question.
Who gets to decide when a Government Official who has lifetime tenure is no longer fit, or able to serve? A panel of "experts"? Whose "experts"?
RBG should have the good sense to step down. But her hatred for the President will probably compel her to hang on to the very last second.....literally.

Hatred is a powerful motivator.
My hatred of liberalism motivates me to try and prevent the spread of that disease.

Read an article last night where the the producers of the movie met with RBG supposedly in person to tell her that the movie "RBG" was up for best pictures. They used glowingly general terms to say she was happy to hear the news. No real description of her condition.

DF - nice post and a good article
Currently the remedy for an incapacitated SC justice is impeachment by the House and senate trial
Alternatives would require Constitutional amendment.
The article's alternatives are not likely to survive an amending process.
we have a process in place.
Never been used to my search of history - but a remedy for incapacitated Justice exists.
Woodrow Wilson had an incapacitating series of strokes in office - and his condition was covered up
https://ahsl.arizona.edu/about/exhib...sidents/wilson
With today's intrusive media- that is not likely to happen again.
The best remedy , IMHO, - is already in the Constitution.

Removal of a Justice for anything other than "bad behavior" will prove very difficult, as the Constitution states that they will hold their office as long as they exibit good behavior.
Refusing to step down when it is obvious that one should is not bad behavior, it is selfish behavior.
But that is not what the Constitution says.

We have to wait for her to die but if she doesn't die naturally, she gets to stay as long as she wants.
When the shoe is on the other foot our old justices will get to stay, also.
