So you will accurately instruct your imaginary political science class with respect to criminal law in this country we have a "Presumption of Innocence" based on AngloSaxon principles as opposed to "Latin" legal principles reflected in Catholicism and the jurisprudence of Latin based countries, which in effect have a "Presumption of Guilt"!
As a consequence of the Presumption of Innocence in the absence of a finding of "guilty" in a legitimate judicial proceeding the "Presumption" remains intact, although it also remains rebuttable.
That's a distinction of significance from what you stated.
As current events are beginning to reveal the "announcement" by Comey was not only a wrong statement of the law when he made it, but apparently was crafted BEFORE the investigation into her email bullshit was completed (in anticipation of her victory in the Fall of 2016). As a criminal judicial proceeding, if that bears out to be true, the process was not legitimate, since the alleged investigation was predetermined and focused on a result of her not being prosecuted.
