Default Warnings And Disclaimers......

I notice more and more Providers are adding warnings and/or disclaimers to their ads and websites lately. Am I crazy or am I the only one that realizes regardless if you post a disclaimer or not, once you walk into a room to start a date, you can still be pinched? Disclaimer or no disclaimer. I'm curious what others think about this.....

I have personally put a warning about my site containing adult material and for the religious fanatics to not even bother entering my site if they are hell bent on me being a hooker. I understand warnings like this.

Here's a warning that just bugs the hell out of me:
"You agree by entering my website that you are an adult and not affiliated with the law."

Ummm, okaaayyyy..... Like a cop is going to just bypass her ad because it states that. Or a 14 yr old boy is going to have the willpower to NOT click on that 'I AGREE' button! Heehee

Ive always wondered this too.. I would think that's an its an invitation to them personally, but I don't do it so I wouldn't know how it works out for others, maybe there will be some good feedback on this topic.

I think the gals new to the game actually believe those to be true. The ladies who have been around a while though, I still laugh when I it on their ads/websites.

Default arrest vs. conviction

I am not sure of the legalities to it, but as I understand it, it is important when it comes to materials that minors may view, which no reputable people want anything to do with. I personally feel more comfortable letting people know that I am available to model and for time and companionship so that they understand that I am not agreeing to anything or offering a service. My attorney suggested it. If they think that you are breaking the law, of course they are taking you to jail. However, conviction is an entirely different matter, in which case disclaimers, emails, advertisements etc. could be called into question and would matter at that point.

Really just my thoughts. I am no legal expert.

ok I give up

what does this mean? how exactly do you screen?

seems to me that it always involves risk for the provider.
first a new guy has to see a provider when he has no references,
If she likes him, she will be his reference and he can see other providers who will take no references or one reference of a provider who took you without doing a backround check

is that right? or is there some other way to "screen screen screen"

Gemma is right, I think we've hashed this out before, but to remind everyone of WHY she's right.

KANSAS Statute 21-3512: Prostitution. (a) Prostitution is performing for hire, or offering or agreeing to perform for hire where there is an exchange of value, any of the following acts:

Yeah you could present your "disclaimer" about not being a cop as evidence you didn't intend to do the deed, but you know, its not an intent crime, once they can prove you agreed to do... 1-3 (and 3 can get you in trouble, whats bodily contact? I hug?) They would probably point out that you were disclaiming:

1) an Ad where you were provocatively clothed, demonstrating you were intent on sexual gratification.
2) where the rest of the ad contradicted your multiple disclaimers
3) YOUR DISCLAIMER PROVES YOU KNOW THE ACT YOU WERE SOLICITING WAS ILLEGAL OR POTENTIALLY SO (which someone else pointed out I think)

Please note... large civil suits have been lost because companies posted signs saying, DONT GO IN THERE ITS DANGEROUS, and when people went in and were hurt, their lawyer pointed out that the company was admitted a dangerous condition, and they had a responsibility to keep the plaintiff out! Who keeps a dangerous condition around! (note... with kids and trampolines... its a nightmare )

So yeah... you might be able to get away with it if you can hire some HIGHLY PAID criminal defense attorney who can shower an overworked prosecutor in so much crap that they just agree to a diversion or something to shut the docket clog up. However, your "BUT HE SAID HE WAS A COP - see disclaimer" defense... isn't going to get any judge outside of the People's Court to throw it out. If they do... you paid someone something... meh.

NOTE: It can't hurt to put disclaimer up, since it doesn't really do anything, except, you know... admitting you might engage in illegal acts, or know the law about what prostitution is... which could go against you. Most prosecutors won't bother digging that far if you don't bring it up... so you're probably safe. But... caveat emptor.

DISCLAIMER: By reading this email, the reader agrees that they are not going sodomize Muppets on the belief that the large hole represents slutty intentions on the part of the Muppet.
