This one actually does requires congress to amend existing laws regarding asylum, which does permit illegal entry provided an asylum case is brought within one year of entry.
One federal judge can stymie unilateral executive efforts pretty quickly. A plethora of them can create a substantial firewall preventing policy to move forward.

Many of the later actions relied upon temporary emergency powers tied to the public health emergency but were halted, paused or tossed out. That emergency ended years ago and the temp authority with it.
Expect lawsuits aplenty, funded by very deep pockets, even if Congress does actually put some legislation on the table. Congres would need to act. It's the path forward that would defang most legal challenges.
