Yeah I’m curious as to what his other handle is/was as well. I imagine from his postings that he is one of those dudes that gets bossed around at home by the wife. She’s a the typical controlling bitchy wife that probably hasn’t given him pussy or a blow job in years. His boss probably doesn’t respect him either. Clearly whoever the coward is doesn’t know me at all. Just because a lady speaks her mind and isn’t a doormat does not mean she’s dominant with gps. Okay, after what Jules said, I felt like I needed to justify myself and prove she IS a domineering bitch (because I only promised I'd stop with Lucas, Jules is still fair game), so I used search to dig up two threads where she was particularly egregious. And... she wasn't. She didn't even post in one of the threads I was thinking of. I looked through her recent posts, and found zero instances of her being anything other than pleasant.

No way around it. I was wrong.

So I'm not sure what happened there. Did I mix her up with someone else? Did I misremember which threads this happened in? Was I drinking and foruming, which made me take offense at things that a normal person wouldn't take offense at? All distinct possibilities.

Jules.... My bad. I wish I had an explanation, but I don't at all. This has made me reconsider all the people I hate and wonder whether I hallucinated the whole thing with them too. Very sorry about that.

Getting back on topic, short phrases on a whore board or anywhere are NOT eligible for copyright. If it’s a short phase or slogan that specifically identifies something like a business, then one might be able to seek trademark protection.

However, regarding a longer post on a “whore” board, I can claim copyright protection on it. If memory serves, as long as my post contains at least a minimum degree of creativity, I can claim copyright protection wherever I write it. Now, claiming copyright protection doesn’t equate to winning in court should I sue the person who stole my work, but it might, especially if they used it for financial gain.

So, Kaitlyn, come up with something super creative and catchy and trademark it. But make sure you use the (™) until you file paperwork and receive registration, then and only then can you use the (®).

Unfortunately because of the career path that I chose, I was forced to take too many law classes. I have no business knowing so much about laws for what I do, but I had to learn and know a lot about nothing. Anyway, I digress, this board is about illegal activity here in Texas. You’re wrong. Lol. Plain and simple. But if you studied this subject before 1979, then you might be right in some cases. But, it think you’d agree, Intellectual Property law has changed immensely even in the past few decades.

This board is protected by the first amendment regardless of a nexus to alleged illegal activity and it’s intended purpose. There is nothing illegal about the existence of eccie. There is nothing illegal about the posts, the only blurred line is whether review recommendations constitute some sort of promotion of (alleged) illegal acts. Which in itself, is a weak argument that hasn’t had much weight in court beyond, perhaps, leverage in a plea bargain. Even the advertising is not illegal because it does not constitute a valid offer.

Copyright starts the minute I put something down in writing. It matters not the venue as long as it’s something original and fixed in a tangible medium of expression, it is entitled to copyright protection and it matters not if I put a © next to it. The © and registering it merely prove its existence and when it was written. What makes a copyright is that it is my original thoughts and ideas, not the circumstances or location of its creation. What makes you successful in court is proving you were the first to register it. That’s why they call sending it to yourself in the mail (and leaving it sealed), “the poor man’s copyright.” Of course there are exceptions for “fair use” etc., but just stealing my words for your own purpose or gain, isn’t fair use.

I will agree that the fill in the blank part of a review are probably not eligible for copyright protection, but the ROS should be. At least two circuit courts (5th and 9th) have ruled that illegal works are eligible for copyright protection (e.g., snuff films, illegal pornography, hate speech). Some district courts (in the 2nd circuit) have disagreed to some point and eventually a case will make it to the US Supreme Court. I predict they will uphold copyright protection in the basis that the intention of copyright laws is not to censor, but to protect creative works. Prohibition of the publication of illegal works is something better addressed legislatively not judicially.

This site is no different in the minds of the court than sites with creative writing pieces and those are also worthy of copyright protection. And yes, if you took this very post and posted it elsewhere as your own (or simply without my permission) and I wanted to pursue it legally, damn right I could.

I would first send you an email, asking you to remove. Then if you didn’t, I would send a request to the webmaster. If that did not work, I would send a cease and desist and takedown notice. I could subpoena the website for your IP address, and so on and so on. I could go on with filing a lawsuit using your alias, but let’s face it, by that time, it would be removed. If you made money from my works, there might well be a paper trial, as well. If not, then the best remedy is a simple removal.

Cases, both criminal and civil are filed everyday without real names. Many times to prevent the statute of limitations from tolling. That’s not unusual.

So, In a nutshell, yes, my original, creative, thoughtful words here, in a tangible medium, are copyright-worthy. If Kaitlyn Dior starts a thread in CoEd with flowery prose and/or creative thought, that too is copyright-worthy. Your post above, is copyright-worthy, regardless of the little © or not. The little © just gives people fair warning that you’re serious about protecting your work.

Another fun fact: you can’t copyright your name. Those engaged in the Sovereign Citizen Movement have tried this and it does not work. It’s an interesting topic to read about though. They sue the government for copyright infringement every time the government uses their name.

I’m not arguing with Lucas, I like him and his take on things. I do know he’s an intelligent guy. That’s why I’m not arguing but rather educating. It just happens to be a topic I know a whole lot about off the top of my head. Plus, it’s definiteoh on topic here on eccie where I get PMs with girls complaining about everything from KD’s concern to girls copying whole websites and stealing pictures or websites stealing content. It happens all the time and we’ve been rather successful with takedown requests when issued.

SO, it’s important to know what is protected and what is not. While I honestly don’t know if eccie TOS gives them superior proprietary rights to what we write here, the solution to that is to have a blog where I post a copy before I post here.

College Fun Girl copied my entire text from my website, verbatim. Even my bio from Twitter then had the audacity to follow me and like my tweets.

And of course I called her out of which she quickly changed, without a response to me.

It wouldn't be a big deal however I actually have put forth the effort into building a website and spent countless hours on the bio, consideration rates etc for someone to copy and paste the work I have done.

Learn to be creative. It's not that damn hard to market yourself.
