theres a problem with this thinking....

you had Obamacare in place since 2009. Hospitals are still getting EMT visits and they are still not getting paid under ACA to cover these visits.

Hospitals may have gotten bit more money but it wasn't to cover those defects of EMTALA.

The new Congress and President Trump must understand the recent findings of RAND: the ED is now the main portal of entry for hospital inpatients for all beneficiaries of CMS programs. Unless Congress also repeals EMTALA, EDs will continue to be the universal portal of entry for hospital care for U.S. citizens without health insurance.

EMTALA constitute an illegal 5th amendment taking.

the 11th district court upheld EMTALA as saying the hospital's involvement with medicare is voluntary.

couldn't find anything if the supreme court accepted this case.
