And , if it was me, I would talk to a lawyer. If he was already aware of the mold, he may be liable for property and healthcare cost. If he was not aware, he may still be liable. That is what his liability insurance is for.
That is just my opinion. But an attorney could do some checking and then do a contingency lawsuit, if warranted.

If the landlord knew about the mold then yes legal action should be taken.
BUT, if the landlord did not know then he should not be liable. Taking legal action if the landlord did not know is wrong. Too many small business owners have lost everything or shut down their business because of these types of lawsuits. IMO lawyers say it is for justice by they are only doing it for the money. They know that most cases will settle out of court just to end it.
