i take issue with the title of this thread

paterno and others did NOT coverup anything FOR sandusky

they covered up sandusky's vileness for themselves

the penn state offical who retired with his $300,000 plus pension in the wake of the disclosures...he covered things up for his salary and pensions sake

paterno covered things up for his record and his money and his "fame"

likewise the rest of them sitting at the top of the heap called penn state played it close to the vest to protect their salaries and benefits and perks and pensions and lifestyles...

thats why they should all be forced to give back these things, be stripped of retirement benefits, and bonus money and positions...be sued individually either by the state or the victims or both...

if by some quirk of the law that isnt possible, future contracts with state workers should have a claw-back clause

there should be a claw back...much like in a bankruptcy case or in the case of madoff, when people made out unjustly, the receiver went after them, as j p morgan plans to concerning their huge trading loss, they are going after these traders and the department heads

There might should be but there isn't.

The only claw back is the criminal law. That should be all the claw back you need.

It appears from your post that you are not into shutting down the program. Most that post are all for throwing out the baby with the bath water. Big emotional girly lynch mob we got going on here. They don't give a damn about the law, they smell blood and they want'em some!

The Penn State football program IS the bath water. How can you possibly want to subject those young men to the abuse they're going to be subjected to at road games all because their school was so damned greedy that it refuses to do the right thing? Do you think the football games should be televised? Maybe the cameras can zoom in on all the thousands of people chanting "San-du-sky San-du-sky San-du-sky". If you think the team won't be taunted on the road you're in complete denial. If they go through with the upcoming season they might become the most hated sports team of all time. Now THAT would be punishing the innocent since the players had nothing to do with the problems so end the suspense, cancel the season and let the players transfer. It's the only "humane" thing to do.

The relative guilt or innocence of the players should have nothing to do with whether or not Penn State gets the NCAA death penalty and is shut down for 1, 2, 3... or however many years.

In EVERY situation where punishment is handed out to a corrupt institution, there WILL be innocent people punished. When SMU go the death penalty, many of the penalized players weren't even at SMU at the time when the other players were getting paid to play.

But, if that is the rule you follow - if you do not punish an institution unless you are sure no innocent person will be punished - then you will effectively NEVER punish any institution.

Of course, the institutions will know this and will behave accordingly - i.e., badly. If you know you are shielded, you will be much more likely to break the rules.

Give PSU the death penalty. It will take time, but it will eventually recover.

And it will send a very healthy message to other schools and future Penn State teams. They will all know that corrupt or illegal activities by the athletic staff, even if not directly related to sports, can still get the sports team banned.

In the future, if some coach or athletic director becomes aware that members of the football or basketball or lacrosse team like to get coeds drunk or high and have gangbangs, or hire hookers for gangbangs, or like to have keg parties at which underage drinking occurs, the coach or director will be FAR less likely to think "boys will be boys" and look the other way.
