Default Privacy laws in our favor

This was posted on TheRegister Private data on phones offlimits

The article points out that if you willingly give them your phone or GPS device that can show location, then you have no expectation of privacy.

But they cannot TAKE it from you and start searching with out a warrant.

Interesting ruling, which, if you read the judge's decision, confirms the denial of a different judge for the original application for a warrant.

Of course, 2 judges (both in the Eastern District of New York) don't amount to a hill of beans in other federal jurisdictions, but it's a start, especially since the application for the warrant obviously was contested by the cell carrier, Verizon.

Hopefully other carriers would share their privacy concerns.
