From talking to an attorney, This was how he explained it to me using an LMT as an example.

The LMT completes with the massage without any sexual contact. You pay in full. After the massage transaction is completed, if both of you decided to go out and one thing leads to another, that's consenting adults and completely legal. UNLESS, there is any kind of agreement between the parties before or during the massage to have sex. And, if you pay substantially more than market rate for the massage, either as the quoted rate or as an excessively large tip, that's considered prostitution even if there is no verbal agreement.

Bottom line is sexual contact during the course of a paid for service can be considered prostitution. Is it worth the cops going after customers at an AMP or Studio? Maybe, maybe not. Depends on their goals. Again up to you to decide if your tolerance for risk is high enough.

There is a huge difference between legal and not worth going after, yet. And people can argue anything. I would love to see a case where someone walked because it was for "time only".

Back in the day, an escort would get hired to attend dinner, etc with a client. The Escort would call in to the agency to start the clock. After whatever the legal engagement was for, the escort would call end to time together. After the client paid the fees, plus a very big tip, of course, the escort was now off the clock. Of course, the client was so nice, the escort would decide to sleep with him, off the clock. Never heard of it working in the 70's and 80's. Doubt it works now.

Technically, all he would need is to convince one juror then I'd say he's golden.

I’m not an attorney, but I expect the cost of a jury trial with a good attorney can easily cost 10k.
