Well, he’s not been convicted of this felony yet, so if that was the reason he has a prior…I think.

I can’t recall if the gun laws add time if you are carrying in the commission of another felony. I think there are additional penalties, but I don’t know if it applies to all classes of felonies, or just the major ones.

Good question, though, if that’s what you were getting at. Anyone who carries better bone up on that before bringing their weapon to a session.

I remember seeing “Lingerie Modeling” advertised where you pay for looking at a woman in a sexy outfit. You could also pay for pictures in lingerie or nudes or just hands or feet. Either taken at the session, by the model or by the customer. There are lots of options for paying for something else, and then just having sex because you both got horny during the photo shoot. And the 10 pictures or so taken will prove the client paid for something that wasn’t sex . Of course there has to be a trust between provider and client for this to work without discussing any sexual acts. This is in fact how escorts always have operated, just charging for their time.

There are options to circumvent that crazy law.

I have read several forums re this subject and it appears many do not get that changing it from a misdemeanor to a felony also changes procedures allowed/followed. Before, popo had to witness the act as with most misdemeanors. It being a felony means proving the act took place and you were involved....but I am no legal scholar so I could be talking out my ass.... lol

The gun can only be a handgun, no rifles or any other gun you carry over your shoulder, and must be secured in it's holster. Convicted criminals are not allowed to do so, but obviously, cops have no idea if you have criminal history unless they run your info. So, if you want to open carry and not conceal carry, then when you are reported to or seen by cops, you take the risk of also being detained by LE to run a background check.

Kinda ingenious if you think about it, as another way to lawfully run checks on individuals who would otherwise not be checked until it is too late and they have fired at, injured or killed someone.

The hobby is not banned in Texas, but it is going to be curbed some, especially when it comes to new providers and hobbyists with no history or references, there should be lots of them pop up soon. It has always been illegal, but after Sept 1, 2021, if you are caught paying for sex, it is now a felony charge.
