I don’t believe the judge was racist or that this case has anything to do with race. After all the black judge granted consideration of the castle doctrine to a white defendant not even in her own apartment. That said I do think the judge caved to the political pressure of the City’s liabilities and gave the prosecutor an undeserved pass by letting the prosecutor violate the gag order.

Would a white judge in Dallas give a black defendant the castle doctrine? Who knows. Can the castle doctrine be used like this again ?

Maybe it’s time for Texas to adopt the Idiot Doctrine for people like Guyger who are not repeat offending monsters but need to be punished. In this case as punitive measure against a cop that made a bunch of bad decisions and for the DPD that made the bad decision to hire her. The charge should be along the lines of negligent homicide or death by stupidity so it it not statistically counted as yet another murder.

Guyger is going to have to stop sniveling and put her big girl panties on for prison. The bitches in the big house are not going to contemplate the merits of her case like us mongers.

The least & most she should have gotten was manslaughter.
Once again, the scales of justice are still unbalanced.
Almost every judge in criminal courts favors the prosecution. They get the discretionary calls. All the time. In almost every courtroom in America. That’s why it’s tough work being a criminal defense attorney. And why you have Appeals that send cases back fur retrial from time to time. But come election time, folks want a law and order judge, not one who bends over backwards to see that criminal defendants get every chance to get an acquittal.

That being said, I figured manslaughter, too. But the gal did shot a man down who was sitting in his own home eating a bowl of ice cream. That’s a tough fact.

yes, like I posted earlier, she made a big mistake to say that forcefully in open court. she should have said "I tried to stop the threat", and not say she intended to kill. I think her defense team erred, thinking that would make murder the only possible outcome, and she would get acquitted

Yeah. She kind of buried herself by saying (or getting trick fucked into saying) she intended to kill him. Anyone trained with a firearm is trained to shoot to kill. That was a loaded question. But what also probably buried her was her affair with her partner and apparently her post on social media out excessive force. The women on the jury didn’t like that.
I wonder what will happen to her partner. He may not be a party to this case but he admitted to deleting texts from Guyger before and after the incident. According to the media they were still sexting after she shot him.

I thought that when you are trained in the use of a Firearm, You are taught to stop the threat, not shoot to kill.

You are taught to aim at the upper torso. That’s the best way to stop the threat. DPD may not advertise it but I’m pretty sure they don’t want their cops pussy footing around when they pull the trigger.

It's training to shoot center-of-mass.

That was good, made a lot of good points.
Primarily: "The fact that Guyger saw no weapons on Jean was key, he said. Guyger testified that all she saw was a body.
"That's not enough to take out a weapon and shoot," Staub said."

She's screaming "show me your hands, show me your hands" like she was in the middle of a SWAT team arrest. She should have tried "Who are you?"

Prosecutor asks whether she meant to kill Botham

Quote:
Hermus asked why Guyger did not back away from the apartment and call for backup instead of confronting her perceived threat.
Guyger was reminded that she took an 8-hour deescalation training course five months before the shooting.
"What did you take from that class?" the prosecutor asked.
"I don't remember," she replied.

I think she gets at least 10 years and since they are on such a roll, maybe 30-50.
However, I still feel like there is laundry list of things to appeal on.
1 - His family met with the Grand Jury prior to her being charged with murder to begin with. My attorney friend said that was unprecedented. Nobody meets with the Grand Jury.
2 - Defective door locks, she didn't bust down his door and he didn't open it for her. Forget the fucking red mat. Maybe, she thought the complex handed them out that day.
3 - Refusing to change the venue - pre-trial publicity was off the charts and Dallas is a known hot zone.
4 - Refusing to allow the jury to hear the testimony of several key witnesses.
5 - The DA violates a gag order and all the judge does is get mad about it.

She fucked up and she is a fuck-up but let cooler heads review this in a different quieter venue. It will not be tomorrow, she's going to do some time.
