Default Legal In Foreign Countries . . .Prosicuted Here?

So someone told me that fiolks who go to countries in the Pacific Rim for sex encounters that are legal in that country, but are not legal here in the USA can be arrested there and tried here. This seems to be directed at child abuse . . .which is fine with me (the prosecution I mean!).

However it brings up other sorts of things. For instance simply engaging in sex for money between consenting adults is legal in many places but not here. Can someone be prosecuted here for spending a day or two in a German FKK club? YouTube is full of "What I did in Costa Rica" videos.

That is prostitution. What about trafficking as it is becoming defined now? Can someone be prosecuted here for bring a Thai bar girl back to a hotel in a Taxi?

Back home now: What about an Uber driver who gets a fare on a Saturday night that turns out to be a provider on her way to an out cal session . . .and it turns out to be an LE set up sting? Is that chargable as Trafficking? What about the John? Can he be charged with trafficking?

this is not an easy question to answer. There are a lot of variables which makes a simple answer impossible.

Obviously local jurisdiction would not have the ability to arrest you on a crime in a foreign country, there jurisdiction ends at the boarder of their territory. You would have to run afoul of Federal laws.

Let's look at the Feds record on the war on drugs. US customs knows of all the major players in Drug rings, yet it took them years to bring them down. Police in the local jurisdiction would have to Grant permission to investigate crimes of prostitution, so unless it's illegal in the country your hobbing, you probably have nothing to worry about. Unless you say something stupid as you re-enter the USA, attempt to smuggle in someone with the intent of forced salvery, or be brash about your intentions (online, or ????) Your risk is low as you would most likely be low hanging fruit.

Feds don't have the time or resources to track one person and his where abouts for several days to obtain a conviction on land outside of the USA.

Hobbiests have been traveling to Tijuana for hobbiests activity for years, and you haven't heard any tails about hobiests being busted at the boarder for hobby activities?

As far as being an Uber driver, it is a crime to transport a person with knowledge an act of prostitution will occur. Once again, it will all come down to the circumstances. Was the driver booked thru Uber website and previously never met? Unless you specifically admit to transporting the person with the intent of prostitution, Probably would be hard to prove. If the driver took the fair after meeting the person at a gathering where providers and hobbiests mingle, that would be difficult to defend.

Criminal defence is a specific section of the law and it's complicated. Even more ECCIE is a multi state website where many differnt laws differ. If it came to a criminal court case there no easy quick answer to your question and a lot of the outcome would come down to the facts, political environment, your level of involvement,and the amount of resources available to law enforcement (i.e. grants to combat the activity).

Not my thing, and I find the thought repulsive.

Please re-read the first statement in the OP.

One thing that got me thinking (there were several items) was a youtube documentary on Japan's so called "JK culture" of sexualizing youth. It mentioned that in parts of Japan, the legal age of consent for prostitutes was 13! This shocked me.

You're asking about legal age.
Prostitution in Japan is ILEGAL doesn't matters the age, you're talking about bars where the girls who work there as waitress and hostess are dressed like teens. They're to entretein not for sex, if the owners have the info that they're offering the phone number or some contact detail they're fired. Of course there're girls doing prostitution, but not easy for independent escorts (police is very strict and Yakuza have the control). I know because some friends of mine were working there and is more difficult than Middle East. And Japan is a country specially obsessed with teens, undergae and submisive girls.

The legal age is the same everywhere and in special cases like in the Middle East it can take you to a federal crime, cancellation of your visa and expulsion from the country after going through jail.

Thank you for that correction. I was miss-informed on Japan. The laws in Japan are complex.

Among other things, it seems that the only prohibited sex act is coitus, the vaginal insertion of a penis. Anything else is not considered a sex act and the prostitution laws do not apply.
