Default Texas sales tax due on massage parlors, escort services

I was doing some research at work today and happened across this:

Hmm. Can't get the link to post. It's Section 3.317 of Title 34, Part 1, Chapter 3, Subchapter O of the Texas Adminstrative Code. Google "texas sales tax turkish baths" and you'll find it.

(a) Definitions. The following words and terms, when used in this section, shall have the following meanings, unless the context clearly indicates otherwise.
(1) Escort service--A business that provides for a fee an employee as an escort, date, or bodyguard. An escort service does not include motor escorting or armored car service.
(2) Massage parlor--A business that provides massage services for a fee. A massage parlor does not include the following, even though massages may be part of their services: health clubs, health spas, hospitals, nursing homes, sanitariums, athletic departments, licensed physical therapists, registered massage therapists, beauty spas, reducing salons, scalp treatments, or slenderizing salons. A massage parlor does include Turkish baths and any business not previously listed that provides massages as at least one of its services.
(3) A Turkish bath--A business in which a customer first uses a steam room and then obtains a massage or rubdown.
(b) Sales tax is due on all services provided by massage parlors, Turkish baths, or escort services.
(c) Sales tax is due on utilities, equipment, towels, and machinery used to perform personal services.
(d) Records must be kept on all services provided by massage parlors, Turkish baths, and escort services. For more detailed information about records required, see §3.281 of this title (relating to Records Required; Information Required).


I wonder if an agency or parlor that uses independent contractors, rather than the "employee" specified in (a)(1), would no be liable.


Well, anyway, I wouldn't want them to get in any trouble, so I'll be adding 8.25% onto my appointment fees.

I'm sure the ladies just put the sales tax into the overall fee. If they had to add 8.25% to the HHR 125 with $100 up charge for Greek and minus the $50 off review special, a few heads might explode.

If the great state of Texas started saying provider services were taxable, wouldn't that some how say they it is a legitimate biz? If it's a legitimate biz it cannot also be criminal can it?

this is a legal profession hun, you pay for time not sexual services/activity. Most women whom have made up their mind this is their profession long term, already been opened an LLC wether they list it as an escort service or a personal trainer... Any lady who has been around for a while, been making money, and is responsible with their money, has an LLC and been paying taxes just like W-2 workers...

Not sure how many people have studied for the CPA exam on here, but it's one of the the first things you learn about taxation when you study for the exam. No, it's not a legitimate business but the IRS doesn't give a shit. They want your tax money whether your income is legit or not. You just get in more trouble when your income is not legitimate so it's just smart to make up an LLC if it's not. If you don't pay taxes and you're an idiot who buys too many things, they'll find you. And back taxes are a bitch for a reason. They're meant to be punitive...oh, and plus the jail time and/or fines you will pay or serve for wasting their time. Government workers don't like to work hard. If you make them do so, you're extra fucked.

Enough info from me. Take the edit CPA review course to learn more like I had to...I edited out the name of the CPA course before I get a nasty gram from a mod. Not sure what the rules are about that on here and I'll be damned if I try to find them.

Edit: whatever you ladies decide to do, do not listen to Mya's less than brilliant advice. DO NOT FUCKING LEGALLY REGISTER YOUR BUSINESS AS AN LLC AND AN ESCORT SERVICE. Why is that? Because you're not in the few spots in Vegas where your services are actually legal. The IRS will have you flagged in no time. You might as well call an IRS agent and ask him or her over for lunch with Mya's stupid ass advice.

I guess that why they have that entertainment code 711510 to use. Double check that number before anyone uses it.
