This means in all likely hood that this is headed for the SCOTUS.
It's difficult to say what they will do. But it all might be a moot point, since a future President Trump will simply nullify President Obama's Executive Order.

Up to this point, both Reagan and Bush 1 AND 2 have acted more like 'kings' than Obama, going by the numbers. The problem is you don't care how many executive orders are issued as long as you agree with the order and the president is of your party. The shoe always sucks when it's on the other foot...

You can look up those executive orders. You'll find that Bush and some others made a lot of EOs about pardoning turkeys, calling attention to some special person, or something else that was benign. Obama doesn't do that. Remember, he is changing the fabric of the nation or that was he promise.
