My guess is that the Feds will see if they can get around the First Amendment problems. I know it's not against the law to right about breaking the law. I suspect it's not illegal to allow someone to advertise services that are not patently illegal on the surface of the add. Requiring an advertising medium owner to go around and read reviews, etc. might well be imposing a substantial burden on commercial speech. The interesting case is where the advertising company also owns the review board. That might make a difference.
