I don't agree with you that paying an entrance fee to a 'swingers' club' constitutes paying a fee to watch people have sex. The 'swingers' club' would, rightly, defend that the entrance fee is for many things, such as socializing, meeting other people, drinks, hooking up for sex, etc. There certainly would not be an offer or acceptance that the fee would be for watching people have sex.

Just curious myself Jon, how about old-school adult movie theaters? Or does the TX law only apply to live sex viewing/shows. And thinking about "peep" shows, watching a live show through the glass for whatever amount of time you purchase.

Hell maybe I'm to old remembering those gems of my youth LOL!

There's no Texas state law banning or even regulating porn theaters that I know of. However, cities have ordinances regulating porn theaters. Porn can't be banned because of the First Amendment (I'm simplifying). Live sex shows could be prosecuted as prostitution. Prostitution includes paying someone to have sex, even if the person paying doesn't take part in the sexual conduct.

I'm from El Paso, and we have multiple Swingers Club, the catch is , theres no "door fee" it's a membership. That's where they legally have clubs full of naked amazing crazy awesome mind blowing sexual adventures. Sorry, I went off on a tangent. It is not illegal to watch couples have sex, pending you're in a swingers club and pay the hefty membership fee, with hot tubs, very naked damce floors, fetish rooms, and private and public rooms galore, it is well worth it. I advise you to look at swing lifestyle sites. You will find having a lurker in the room is a very common request. Have the most wonderful of days. =)
