My understanding is laws have always been in place. but the courts had struck down key parts that basically made them meaningless. There is a deadline later this year that if the laws were not fixed/replaced they would become nul and void.

Basically correct.

Prostitution has always been legal in Canada, but there were always a few laws on the books that prohibited street prostitution, brothels, and pimping. Those laws were struck down as unconstitutional last year, with a deadline for new laws to be put in place by the end of the year.

We currently have a conservative majority government, which will be able to slam through any laws they want. This law in particular is bound to face another constitutional challenge though, which will take years to wind through the courts. They are basically putting back in the original laws with different wording.

One of the new laws specifically prohibits any company from knowingly allowing sex for money advertisement on a website, in a newspaper, etc. It's really just a rewrite of the old "communicating for the purpose of prostitution in a public place" which was struck down last year.

It's actually a very minor change in how things have been for a hundred years in Canada, and time for money will always be legally advertised. Prostitution has never been truly wide open up here, and it never will be. Legally, there will always be laws to address the nuisances (street prostitution, graphic advertising, pimps).

People in the community are very upset about these new laws, but I don't expect things to be much different than they have been up here than they have been as long as I've been in the business. Regardless, we are going to tighten things up now that websites are specifically addressed, and continue to operate as a legal Canadian business.

Always,
Gina

Problem with any sex laws, US or Canada is it's not popular to support them in public...thus the same people saying how terrible porn shops or prostitution is in front of their wives or friends are the same guys sneaking out for a session with their ATF on here or a BJ from another guy in the private viewing booths at the local "adult" arcade.

Funny though - sex industry seems to be bringing in a LOT of money BCD when so many claim it's a terrible thing in public.

I see less and less value in my P411 membership. 90% of the providers I see don't even log into it anymore.

this is worrisome....I always use P411 as my decision maker if I'm on the bubble. And the 2 features that are about to go away, it seems, were the main reason why.

Ms Gina, you run a fine site and I know you're working like crazy to stay ahead of the changes.....selfishly I wish you the best of luck

A number of providers have suggested that I put the providers in charge of policing the P411 Ad Board, in order to be able to keep it alive. That just might be an option, and if a put a point reward system in place, that idea might actually work really well.

All options are being considered!

I rarely look at the p411 ads, mainly looking at the provider's pics, location, days and hours of availability and donation rate, then when they all match up with what I am looking for, her menu of services and lastly, recent ads placed if she has one.

I think that will work but just with providers that have been here longer than a year. newbie providers have proven to everyone that they are not up to the task. Example: on eccie welcome wagon, They are allowed to post Rates, Services or acronyms, nearby locations, pictures, etc.. there is a sticky with 7 points of suggestions from NYR, do they answer it, read it, or even post what it suggests? NO!

Here is that link in question:

Would that create sufficient distance such that you could not be held responsible for what's posted? If not, I wouldn't trust my livelihood to a third party in that way.

It seems to me the safer bet is to put limits on what can be placed in an ad, force compliance by use of a template, and allow a link to the site of their choosing where they can post anything they want (eg, services).

That's a good suggestion. I think Tin is onto something.
Having 9 years in with P411 has been invaluable. Thank you Gina and I know you'll figure it out.

This is being considered as well.

It basically boils down to the final writing of the new law, which we will most likely have on Nov 16 (and will be put into place Dec 16).

Currently it reads "anyone who knowingly allows the advertisement of sexual services for consideration....". We will not be allowing any mention of sexual activities, and there will be plenty of checks put into place that will help monitor the site for it.

So we shall see. Regardless, I'm sure it will all work out the way it supposed to.

Always,
Gina
