Watch out for new police sting tactic. The new tactic is to place an ad on the internet and lure the John to the parking lot for the sting. Once there, they will sting the John for soliciting prostitution services.

They have not done it to escort yet. But it is possible if escorts are willing to meet hobbyist in commercial areas or the streets.

I wrote " Lawrence v Texas- Cops cannot set up escort sting without warrant!!" in the " A Question of Legality" in the EECIE hobby board. It explains how you have protection against unwarranted stings in hotel or motel rooms. You don't have the same protection on the streets or parking lot of commercial areas.

Also I want to warn you about new police sting tactic of soliciting over the phone, trace the caller, and come to arrest you at your home. They don't need a hotel room and can do the solicitation over the phone.

Remember, never make any comments or ask over the phone about sexual services. Code words will get you into trouble as much as plain language. Just keep it to watching TV, massage, or companionship.

Your advice is totally in the wrong.

Cops with reasonable cause to suspect or believe a criminal act is in progress, especially in a public place, never ever need a warrant to arrest anyone.

And, if they have reasonable cause to suspect or believe a criminal act is in progress in a not-so-public place, they usually can enter, make an arrest or at least hold suspects and then get their search warrant to poke into less than visible spaces.

As far as your "Lawrence v Texas" argument is concerned, cops are not versed in Court cases. They make their arrests based on probable cause and then let the lawyers and courts sort things out.

Warrants are never needed to open an investigation. Warrants may be necessary to wire-tap, to search a private home, business, etc. Have you ever heard of exigent circumstances?

Your "cases" are a clear and present danger to hobbyists and providers but, certainly, those following your advice and who thus get caught up in court certainly will be giving attorneys their cold, hard cash and suffering public exposure if not ridicule.

This journal article back up what I am saying. I am NOT saying that police CANNOT arrest someone in private without a warrant. If you get arrested and they don’t have a warrant, you should discuss it with your attorney to a federal civil rights lawsuit against the police and the department.

I think that police should discuss this matter of unwarranted government intrusion with the District Attorney Office before doing a escort or hobby sting. It is WRONG for police to arrest people without due process of law or misapply the law. I understand there is probable cause but arresting people without following the laws is WRONG. Probable cause is evidence that a crime may occur and the person meets the requirement of committing a criminal offense. The officer’s right to arrest based on probable cause doesn’t give the officer the right to not get a warrant, misapplying the law, or arrest anyone the officer likes.

That is my assessment of liberty under the 14th amendment.
The federal judges are the ultimate arbitrators of this issue. 42 USC 1983 federal lawsuit will allow an escort or client to ask the federal question do liberty extend to private dwellings of escort and client.

It is not that I have to be correct. The idea is to ask questions. Remedies sometimes are sneaked in court cases. You have to find it and confirm it with law journal articles.

Let me be clear. I am no way in supporting neighborhood disturbance. I believe escorts should be subject to the same ordinance concerning home business if it is conducted in a private dwelling. The city, town, or county should be allowed to limit the amount of clients an escort have in a private dwelling in a day .

This current "prostitution is illegal" crap is not helping to regulate this line of work. Since it is illegal, there are better chances of heavy traffic from hobbyists or johns from an escort business.

“Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.” - 42 USC § 1983

3rd rule of going to a notel parking lot - if they ask what type of car you drive, tell them a lie. If you are pulling into the parking lot as they ask tell them you are already parked ask for the room # - yet still lie about type of car.

give description of car already there. ALWAYS!! and I mean ALWAYS use hands free talking so if they see you, they do not see you talking on a phone.

If they give the room #, tell them you will be right over.. do not take the direct route, take the back way if you can circle around. This way you can scope out anything.. if it looks fishy and they have not see you. Park and walk in a different direction as though you are visiting someone else.. wait a few minutes, return to your car, leave slowly and quietly... (no spinning of tires) if they call you asking you where you are.. tell them you as you were parking you saw cops on the other side raiding a room for something.. that will make them think

The type of sting I was talking about is not really escort appointment sting. It is an streetwalker sting but advertised over the internet. How the sting works is putting an ad on the internet. When the John calls, the undercover officer arranges to meet the John in a parking lot for the John to pick up.

Yes, I like your advice. You still have to be careful with the stings going to an hotel or motel. If the other end ask what type of car you are driving or what type of sexual services, it is a red flag. The best way to know what type of services is to go onto the hobby boards.
Never assume they will not try new tricks.

Besides the sting tactic I mentioned above, recent news articles document police are doing the new sting tactics. Let the Hobbyist discuss sexual services over the phone, trace their phone number, and arrest them a few days later. This is a time saver to practice this new sting tactic. It is a resource saver because they don’t have to rent a room and have a team of police officers on staff.
