Default Mugshots

Since mugshots have come up in a few posts, I thought I would post this link to an article about how mugshots can haunt you. My feeling is that this holds true for lots of things on the internet - Facebook, Myspace - etc.

Doesn't the problem here begin and end with the government? If they are going to sweep everyone into the mug shots on arrest, then it seems that until conviction that is where it should stay--if not be erased; and after arrest they should be subject to enforceable expungement--meaning no outside or private sale of data.

A state compelled picture should never be subject to transmittal to others or copying without restrictions, and many states have passed restricted transfer laws for that reason. Motor vehicle records are an example. And it doesn't seem to me legal acquisition of a image would restrict the penalty for illegally using it. Taking a government compelled document and using it for extortion appears to me to still be illegal, and perhaps itself subject to prosecution and civil liability. Many things are benign, but when misused that doesn't mean they retain their innocent protection.

But the issue here is illustrating how stuff gets on the net and stays. The warning is made well. I don't understand the Facebook and Twitter mentality. People put stuff out that they would be mad about seeing disclosed by others outside of that. You would be floored by how much a very little amount of incomplete data can lead to unlocking everything about you. The saying in WWII was 'Loose lips sink ships.'Just imagine the difference in availability of information then and now and yet it was a demonstrable concern. It sinks a lot more than ships in this day and age.

It's going to get even worse. Many states compel DNA tests upon just arrest now.

My personal policy is that can mop my DNA off the floor, that's the only way they are going to get it out of me.

Was reading about how there is a crack down on the mugshot sites by the financial institutions. What is happening is these mug shot companies scour through the arrest mug shots, then post them on their website. Then they charge like $400 bucks for them to remove the mugshot. Lots of scams in this I am sure, whos to say they take it down, then put it back up in a month. Then you have to pay to get it removed again.

It looks like credit card companies and paypal at least will not take payments for "mugshot" type companies. American express and Paypal first and I think mastercard, visa, and discover aren't too far behind.
