Default Feds can't force Domino's founder to offer contraceptives, judge says

I don't necessarily agree with this guy's religion, but this is still a victory for those who love Liberty!

From the article:

A judge on Thursday blocked the federal government from requiring the founder of Domino's Pizza to provide mandatory contraception coverage to his employees under the health care law.

U.S. District Judge Lawrence Zatkoff granted a preliminary injunction against enforcement of the contraception provision of the law against Tom Monaghan and Domino's Farms Corp., a management company located near Ann Arbor, Mich.

The company, which is not connected to Domino's Pizza, has 45 full-time and 44 part-time employees, according to its court filing. Monaghan sold his controlling stake in Domino's Pizza in 1998 to private equity company Bain Capital and sold his remaining Domino's stock in 2004, according to Domino's Pizza spokesman Chris Brandon.

"It is in the best interest of the public that Monaghan not be compelled to act in conflict with his religious beliefs," Zatkoff wrote.

I thought that the requirement only applied to FIFTY or more full-time employees although I recall reading that such a requirement could include what is known as FTEs (full-time equivalent - part timers in summation equating to full-time). I am presuming at this time that this would be the case since there is no clear definition in either your post or the article. Also, with his refusal to offer ANY contraception coverage, even optional where the employee would pay for it, would he in effect be violating his employees religious beliefs/rights if their beliefs do not align with his? I do not believe in the mandatory coverage for birth control, however I do believe that is should be an option payable by the employee if so desired. IMHO this would not violate religious beliefs of the employer and yet still uphold the spirit of the law and also allow the employees to follow their beliefs.

Well at least NOW I know that pizza delivery boys will be free to procreate at "will" and spread their seed where there is no need!

COG this is a dangerously slippery slope. Corporations have never gotten exemptions from Federal Laws based on religious objections, and there is good reason for it.

Will it now be policy that Chik-Fil-A is allowed to fire gays because it is against the CEO's religion?

Will it now be policy for a Jewish employer to fire an employee for eating pork in the lunch room? Can a Muslim employer do the same?

What about an atheist CEO who fires any employee who wears a Crucifix or Star of David to work?

Why do equal employment laws that forbid all of the above not apply to religious beliefs, while Obamacare for some reason can not be enforced where religious beliefs are concerned?

I think Obamacare is the worst idea this country ever had, but the religious angle just doesn't fly.

SOTF, what business is it of government who a businessperson hires, or what pay or benefits are offered that person? How much authority do we really want to give government in our daily lives?
