Porn question

Definition: A sexually oriented business is one that has:

1. "as one of its principal business purposes" [FW/PBS v. City of Dallas], or
2. its "primary purpose" is [Renton v. Playtime, Inc.], or
3. has "a substantial or significant portion" of its business stock in trade or activities relating to "specified anatomical areas" or specified sexual activities" [Young v. American Mini Theatre]

So if I have a video salon that mostly plays non adult films but decide once or twice a week to show porn would it be considered a sexually oriented business?

If someone wanted to claim it was a sexually oriented business, my guess is that they could argue...

1) 2 days a week showing porn = 2/7 of your activities = 29% of your activities, and 29% constitutes a "substanital or significant portion".

2) Despite how often you conduct non-sexual activities, the majority of your business/customers/income is based on those activities that are sexual, so you do in fact have a sexually-oriented business.

...or something else along these lines.

I wouldn't go to a business to watch porn. I might show up to a private residence..but not a business. My opinion.

Kinda reminds me of people who continue to try and legally have 8-liner businesses. Eventually, they catch you. I say if you're gonna do it, keep it UTR.

Well actually I wasn't thinking two whole days of porn, more like out of 20 movies being shown in a 6 day period, two movies would be porn (say like tues and thurs night at 9). This I would believe would be only 10%. Of course what is the magic percentage to equal substantial or significant. PLUS it would be by invite only, as in not open to the general public type nights... don't know if that makes a difference...
