Congress can clearly delegate it's powers of other portions of the government if it is done so by majority vote. They did so in a similar manner with the Base Closing Commission. Likewise, they similarly delegate regulatory rule making to the executive departments under the Administrative Procedures Act.

Furthermore, there is no real danger of Congress' power being usurped in this case because any reconmendations of the panel is ultimately to be voted on by Congress in each bill I've seen. It is just voted on under accelerated procedure, with no amendments and no filibusters.
