I don't give LE a pass for lying (intentionally misrepresenting the facts), but given the history of the prior events in which this suspect was engaged and his apparent refusal to give up in the initial stages of the confrontation prior to any gunfire could justify the deadly force. Frankly I am surprised he survived any significant salvo in a fiberglass boat.
Unfortunately for the general public we may never know the FACTS, but I am willing to hold my opinion of a gunfire exchange based on the conflict until credible direct evidence presents itself, as opposed to reports from some unidentified source (meaning specific person with direct knowledge and authority to release the information).
