Yeah, tort reform was passed in 2003 and non-economic damages were capped.

And, Abbott has championed them all because nimwits like you are too stupid to realize that when they support things like damage caps on medical malpractice lawsuits, they are fucking themselves and everybody else that ends up as a victim of medical malpractice. Quick example: let's say your three old child, or your stay at home wife, or your retired father is killed by an anesthesiologist who administers the wrong anesthesia to that family member. The most money you would likely ever be able to receive in that situation is $250,000.00. Maybe you think that's fair....I promise you if it was your loved one, you wouldn't.

In Abbott's case, he has supported limitations on claims that legally, fall into the same category as the case where he received, at least reportedly, a settlement that will eventually top $10,000,000.00.

Just so you won't get an erroneous impression, I opposed the Constitutional Amendment and the legislation as it related to caps on damage awards (NOT LIMITS ON SETTLEMENTS). The medical associations lied about it, right along with the lawyers who represented the carriers for the malpractice insureds, to get the amendment passed, and that paved the way for the legislation. BUT none of it limited "settlements" ....

I actually agree. These extraordinarily low caps basically screw the working man and preserve the status quo for the already wealthy incompetentes.

I support lawsuits and believe them to be effective forms of regulating/reigning in out of control practitioners and industries.

And multi-million dollar payouts to plaintiff attorneys are as bad and egregious as are capped damages.

Cap attorney fees, NOT plaintiff awards.

The Chapter you quote was amended in 2011. A couple of years (snick) after Abbott made it rain for himself.
