No, they cant be. Otherwise, they would already have been.

You can't right a statute that captures every type of homicide where guilt is certain, but never captures a murder where there is possibility of doubt, however small.

Statutes are written be people and people are fallible. As a conservative, you are supposed to know that.

Perhaps the time has come when we should have a court that is dedicated to only one type of crime, that being capitol Crimes that are subject to the Death Penalty.

Have it presided over by a Judge that is of highest character, preferably a minority person. (anything but a white male). Have a state wide jury pool, and be willing to pay the jurors expenses.

To insure that there is no chance of bias, 7 of the 12 jurors would have to be of the same race as the defendent.

This court would try only death penalty cases, and the Court of Criminal Appeals, (the highest Texas Court), would emmediatly hear and rule on any conviction.

Sentence would be carried out no less than one week after the Court of Criminal Appeals ruling that a death sentence would stand.

This way, there could be no cries of bias, no problems with regional differences, and the cost would be lower because if nessessary, the penalty would be carried out quick.

This court would also be open fully to the press, so that all testamony could be reported to the public emmediatly.

I think this would work, and as a benefit, save money for the State, considering how much we spend housing these convicted criminals for decades.
