It doesn't matter where they post as long as they don't use the words massage or massage therapist. If you use those words and you're not a licensed massage therapist or massage establishment, them you open yourself up to either state department of health issues or possibly LE issues. Neither organization really patrols that section to make sure you are or are not licensed. Backpage stopped checking. Maybe that will change now with the glut of new ads.

You can do a massage session anywhere you choose, with or without draping, if you're a licensed massage therapist.

I dont think the feds shut it down they pressured the credit card companies and banks like they did with online poker. I would not worry about eccie or p411 getting shut down.

Actually-- in Texas you can't use the term bodyrub or any other word that can be considered a substitute for "massage" either... Addison PD has gone after ladies who advertise "bodyrub" without a license. Its an easy arrest for them.

Just reading what's quickly available, it seems they always relied on the safe harbor provision of the DMCA, but fucked up by editing ads themselves. The article implies that the BP staff helped users fix ads that would have been incriminating. A site owner can't have it both ways - you can't use the safe harbor provision AND edit the content yourself, as it can then be deemed that the content is not truly user generated. They likely realized they fucked up and had their backs against the proverbial wall.

All speculation, of course. I'm not an attorney, but I spent an hour in a Holiday Inn Express the other day.
