Here is a true story.

Guy gets into a verbal fight with his live-in girlfriend and goes out and gets really drunk. Comes home to find the door locked. Being drunk and really pissed, he breaks down the door. Only problem is he breaks down the door of the wrong house and the homeowner shoots him. He has had 2 or 3 major operations and needs at least one more.

Had he not been shot, his only crime probably would have been destruction of private property.

Under the fairly recently passed "Castle Law" in Texas, I would think that no charges would have been filed against the shooter. In another state where the "Castle Law" does not exist, he would probably have been arrested.

Comments?

FWIW, the "Castle Law" is one of the gun laws with which I disagree. My opinion is that if you are going to try to take someone else's life, your life should be threatened. And in this case the homeowner's life was not threatened.

I doubt he would be charged in most states. When someone kicks in your door you better shoot first and ask questions later.

Been a lot of stories of someone shooting first when they are disturbed at night.One father shot his college daughter who cane home late.Most states will let you protect your home,but your life should be in danger if you use deadly force.Don't shoot them with hot reloads use factory ammo.

You know you can always come up with scenarios that obviously shouldn't have happened. These are not the norm. I can come up with examples of victims that didn't have a gun and wish they had. Hollow points are the way to go.

The law in most states is that you must be in danger, pretty much fear for your life, before you can legally use a weapon in deadly force. This homeowner's life was not in anyway in danger. No idea whether people in such incidents have been charged or not.

I do know that recently in nearby Round Rock. Texas, a homeowner saw a suspicious individual hiding under his car. Guy got out from under the car and started running. Homeowner shot and killed him, I believe. At the least wounded him. He was arrested since his life was never endangered.

Possibly. I was just wondering about people's viewpoints on an actual situation. Personally, if I shot and killed a person who was in no way a threat to me, I would put down the gun and never pick it up again. If you or others think otherwise, so be it.

That pretty much sums it up. Someone kicks in my door I am assuming that they are not there for a sandwich and a beer.

In this case it's not an accidental shooting. He shot exactly who he intended to shoot. The drunk is the one at fault. You live with it.
