Not a treaty and never ratified by the Senate. I already made this point on another thread. JD, why don't you read your own Wikilink?

Russia has violated 1, 2 and 3. All we are obligated to do in response to the Russian violations is #6 - consult with each other. That is the extent of our OBLIGATIONS under this memorandum (which is not a treaty, JD). Our OPTIONS are a different matter.
